Zgodnie z brzmieniem art. 58 § 2 ustawy z dnia 25 lutego 1964 r. Kodeks rodzinny i opiekuńczy (Dz. U. z 2017 r., poz. 682 - zwana dalej k.r.o.), jeżeli rozwodzący się małżonkowie zajmują wspólne mieszkanie sąd w wyroku rozwodowym orzeka także o sposobie korzystania z tego mieszkania przez czas wspólnego w nim zamieszkiwania rozwiedzionych małżonków. Sąd może zostać zwolniony z przedmiotowego obowiązku jedynie na zgodny wniosek stron. Nie ulega wątpliwości, że zdarzają się sytuacje, iż w trakcie rozwodu małżonkowie są skonfliktowani ze sobą do tego stopnia, że jeden z małżonków uniemożliwia drugiemu korzystanie ze wspólnie zajmowanego mieszkania (chociażby bezustannie wszczynając awantury, zakłócając ciszę nocną czy wręcz blokując dostęp do pomieszczeń znajdujących się w lokalu). Pojawia się wówczas pytanie czy mąż lub żona - którzy wskutek zachowania swojego małżonka nie mogą przebywać we wspólnym mieszkaniu - mogą zabezpieczyć na czas trwania rozwodu swoje roszczenie wynikające z wyżej przywołanego przepisu prawa.
Niestety, ustawodawca na tak postawione pytanie nie odpowiada wprost, a przegląd orzecznictwa prowadzi do wniosku, że sądy reprezentują w tym zakresie dwa odmienne stanowiska. Dla przykładu Sąd Apelacyjny w Krakowie w postanowieniu z dnia 23 sierpnia 2016 r. wydanym w sprawie o sygn. akt I Acz 1319/16 (LEX nr 2106851) wskazał, że "celem postępowania w sprawie o rozwód jest orzeczenie o rozwiązaniu małżeństwa lub jego dalszym istnieniu, zaś orzeczenie w przedmiocie korzystania przez byłych małżonków ze wspólnego mieszkania, wydawane stosownie do art. 58 § 2 k.r.o., jakkolwiek - w sytuacji zajmowania przez strony wspólnego mieszkania - obligatoryjne przy orzeczeniu rozwodu, to jednak ma tylko akcesoryjny w stosunku do rozwiązania małżeństwa charakter i z pewnością nie można przyjąć, ażeby takie orzeczenie miało być celem postępowania w sprawie o rozwód. Nie można uznać więc interesu prawnego którejkolwiek ze stron procesu o rozwód w udzieleniu zabezpieczenia w tym przedmiocie". Niemniej jednak pojawia się także pogląd odmienny, a mianowicie że małżonek w toku postępowania rozwodowego może mieć interes prawny w udzieleniu zabezpieczenia roszczenia o ustalenie sposobu korzystania ze wspólnie zajmowanego mieszkania w sytuacji, gdy w następstwie zachowania drugiego małżonka przejściowo nie może korzystać z lokalu (tak Sąd Apelacyjny w Poznaniu w postanowieniu z dnia 6 marca 2013 r. wydanym w sprawie o sygn. akt I ACz 395/13 oraz Sąd Okręgowy w Koninie w postanowieniu z dnia 21 stycznia 2013 r. wydanym w sprawie o sygn. akt I C 737/12).
W konsekwencji uznać należy, że gdy konflikt rozwodzących się małżonków przybiera takie rozmiary, że jedno z nich próbuje uniemożliwić drugiemu korzystanie ze wspólnego mieszkania to warto w postępowaniu rozwodowym złożyć wniosek o udzielenie zabezpieczenia wyżej wskazanego roszczenia. Strona składająca tego typu wniosek ponosi niewielkie ryzyko, a istnieje duże prawdopodobieństwo, że sąd uzna, że możliwe jest udzielenie takiego zabezpieczenia. Jest to tym bardziej zasadne, że trudno zgodzić się z przedstawionym wyżej stanowiskiem Sądu Apelacyjnego w Krakowie albowiem art. 730 ustawy z dnia 17 listopada 1964 r. Kodeks postępowania cywilnego (Dz. U. z 2018 r., poz. 1360- zwana dalej k.p.c.) oraz art. 7301 § 1 k.p.c., które określają krąg spraw, w których możliwe jest udzielenie zabezpieczenia oraz jego przesłanki nie wskazują, że jest to niedopuszczalne w odniesieniu do roszczeń, które mają charakter akcesoryjny, a nie główny.
